When it comes to custody it is important that the child’s best interests are kept in mind. Although divorce is difficult on everybody, it is something that children often times struggle with more than adults. The factors that determine who receives custody of a child include:
1. The bond between the child and the parents. Is there one parent that the child better connects with? 2. The physical and mental health of the parents. 3. The lifestyle of the parents. Does one parent have a history of alcohol abuse? Any social factors will be taken into consideration. 4. The ability for the parents to provide for the child. This includes everything from food to clothing to medical attention. 5. The preference of the child. If a child is older than a particular age, usually 12, they will have some say of which parent they want to live with. It is important for parents to consider their children first and foremost in a divorce. While the court of law can be brought in to mediate the situation, it is much easier if the parents work together to find the best situation for their children. The above five factors, among others, determine who receives custody of a child after a divorce. If these factors do not point towards one parent the court often times favors the one who will be able to offer the most stable environment. The bottom line is simple: if you are going through a divorce and have children you should do what is best for them. If possible, work with your ex-spouse to agree on a situation that suits both of you, as well as your children.
