As a general rule, changing a visitation schedule during a divorce is difficult. However, that being said, it can still be done. The reason it is often difficult is that the court want to avoid letting the spouses use the children as negotiating cards. Thus, when asking for a change in the pre-divorce visitation schedule, it is wise to proceed cautiously and have strong reasoning for your request. The first step is to always attempt to negotiate with your spouse. If this is successful, be sure to get all negotiated agreements in writing and have your lawyer file these stipulated agreements with the court. If you must seek a court order for a change, you and your Michigan Family Law Attorney will sit down to write out your argument for why the change is necessary. A court will not change a visitation schedule to make it more convenient for you, but changes in work schedules or relocation to be closer to the children are legit reasons. With your Michigan Child Custody Lawyer, you will next file a Child Visitation Modification petition with the court and then present your case in court.
