A divorce can have a significant effect on ones Michigan immigration status. One of the most common issues is the validity of a H-4 visa during or after a divorce. A H-4 visa is what a dependent or spouse is given when their spouse gets a H-1B visa. Although it does not allow one to work, it does allow one to remain in the US with their spouse. According to H-4 regulations, it remains valid until it expires or until a divorce is finalized. At all points during a separation period, the visa remains valid. Once the divorce decree is entered, the visa automatically terminates. This leaves one with two options. On the one hand, they could not get divorced and instead become separated, thus preserving the validity of the H-4 visa. On the other hand, one can take the necessary steps to change ones status and request a new visa prior to the finalization of the divorce. Your Michigan Family Law Attorney and Michigan Immigration Lawyer can help you either of these options.

Now is the time to address this pressing humanitarian issue which affects so many lives and undermines basic human dignity. Our society should no longer tolerate a status quo that perpetuates a permanent underclass of persons and benefits from their labor without offering them legal protections.
