Your Michigan Dog Bite Injury Lawyer

It can happen to anyone – one minute the dog is friendly and the next minute it bites you. Regardless of the type of dog or extent of the bite, dog bites are serious injuries. Besides the immediate pain and medical attention required, depending on where the bite is, long lasting effects may occur. For instance, a dog bite to your arm or leg may cause serious muscle damage that affects your ability to walk and move. This of course means your ability to work may be affected – meaning you could suffer from a financial injury in addition to your physical and emotional injuries.

Although no amount of money can fix your physical and mental injuries, the law has created a system of compensation to try to mitigate the effect your dog bite injury has. From providing for medical expenses and treatment to compensating you for any loss of income or employability – making sure you collect the compensation the law offers is an essential step to overcoming this traumatic event.

As a Michigan Dog Bite Attorney who has handled a multitude of dog bite injuries, our attorneys understand both the personal and legal side of the case. From proving negligence and defending against a contributory negligence defense to working with you to get you the physical and emotional treatment you need – your Michigan Dog Bite Lawyer will ensure your case gets the justice and compensation it deserves.

Michigan’s Dog Bite Law

According to Michigan law, if

  1. A dog bites a person
  2. Without provocation
  3. While the person is on public property or lawfully on private property

The owner of the dog will be held liable for any and all damages suffered by the bitten person, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.

(Michigan Code 287.351(1))

How Do I Know if I was Lawfully on the Property?

The law considers you “lawfully on the private property” of the dog’s owner if you are there in order to perform any duty imposed on you by the laws of the state, postal regulations of the United States or as an invitee or licensee of a person lawfully in possession of the property. People who come upon the property for the purpose of committing an unlawful act are not covered by this protection.

(Michigan Code 287.351(2))

Is there a Time Limit for Filing a Claim?

The statue of limitations – or amount of time one has to file a claim – is three years. In other words, from the time you suffer a dog bite injury, you have three years to file a claim or lawsuit. If the person bitten by a dog is under the age of 18, they have until they turn 19 to file their claim.

So I’ve been Bitten by a Dog, Now What?

If you have experienced a dog bite, the first step is to immediately report the incident. Typically you should call the police or the local animal control department. Regardless of whether or not you think your case falls under the above cited statute, you should seek medical attention and carefully document all of your injuries to the medical professionals.

Remember, petting a dog is not necessarily an act of provocation.

It is also beneficial to take quality photographs of your injury – especially immediately following the bite. If anybody asks you to make a statement regarding your injury, always first discuss the situation with your Michigan Dog Bites Lawyer.
